Supper BearTerms of Service
These Terms of Service ("Terms") are a legal agreement between you and BRCG Digital Partners Inc. ("BRCG," "we," "us") governing your use of the Supper Bear app and website (the "Service"). These Terms also serve as the End User License Agreement ("EULA") for the Supper Bear application. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Supper Bear helps households plan meals, browse and save recipes, build grocery lists, and track a shared kitchen and pantry. The Service is provided free of charge. We may change, suspend, or discontinue features at any time.
2. Eligibility and accounts
You must be at least 13 years old (and the age of majority where required) to use the Service. You are responsible for activity under your account and for keeping access to your email and devices secure. Sign-in is passwordless; protect your email account accordingly.
3. Households and shared content
A "household" is shared via an invite code. Anyone with your code can view and edit your household's plans, lists, recipes, and kitchen. Share your code only with people you trust. You are responsible for content you add and for the people you invite.
4. Your content
You retain ownership of the content you create (custom recipes, photos, notes). You grant BRCG a limited, non-exclusive license to host, store, process, and display your content solely to operate and provide the Service to you and your household. You represent that you have the rights to the content you upload and that it does not violate any law or third-party right.
5. Acceptable use
- Don't use the Service unlawfully, or to upload content that is infringing, harmful, or abusive.
- Don't attempt to breach security, scrape, reverse engineer, or disrupt the Service.
- Don't misuse the AI features to generate unlawful or harmful content.
6. Recipes, AI output, and food-safety disclaimer
Supper Bear provides recipes and AI-generated suggestions (including ingredient substitutions, scaling, and cooking tips) for general informational purposes only. They are not professional nutritional, dietary, medical, or food-safety advice. AI output may be inaccurate or incomplete. You are responsible for verifying ingredients and preparation, especially regarding food allergies, intolerances, dietary restrictions, and safe cooking temperatures. If you have a medical or allergy concern, consult a qualified professional. BRCG is not liable for any reaction, illness, or harm resulting from recipes or suggestions in the Service.
7. Intellectual property
The Service, including the Supper Bear name, logo, design, and software, is owned by BRCG Digital Partners Inc. and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial household use.
8. Third-party services
The Service relies on third parties (for example, Apple, Google, Vercel, OpenAI, Anthropic, and Resend). Your use may be subject to their terms, and we are not responsible for third-party services.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRCG AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless BRCG from claims arising out of your content, your use of the Service, or your violation of these Terms.
12. Termination
You may stop using the Service and delete your account at any time (Household → Delete account). We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction, except where applicable law provides otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide additional notice where appropriate. Continued use after changes means you accept them.
15. Apple App Store — additional terms
These terms apply when you obtain Supper Bear through the Apple App Store:
- This EULA is between you and BRCG Digital Partners Inc. only, not with Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the Service.
- BRCG, not Apple, is solely responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
- BRCG, not Apple, is responsible for addressing any claims relating to the Service, including product-liability, legal/regulatory, and consumer-protection claims, and any claim that the Service infringes a third party's intellectual-property rights.
- You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list.
- You must comply with applicable third-party terms when using the Service.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
- The license granted is limited to use on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
